1 Terms of Agreement
These Terms of Service ("Terms") govern your access to and use of the Infin8Content platform and services ("Service"). By accessing or using Infin8Content, you agree to be bound by these Terms. If you do not agree to any part of these Terms, you may not use the Service.
Infin8Content, Inc. ("we", "us", "our", or "Company") operates the Service. These Terms apply to all users, including casual browsers, registered users, and premium subscribers.
2 License to Use
Subject to your compliance with these Terms, Infin8Content grants you a limited, non-exclusive, non-transferable license to access and use the Service for lawful purposes only.
2.1 What You Can Do
- Access the Service and view content
- Generate articles and content using our AI tools
- Integrate with compatible CMS platforms
- View reports and analytics related to your account
- Export your generated content in supported formats
2.2 What You Cannot Do
- Reproduce, modify, or distribute Service content without permission
- Use the Service for unlawful or fraudulent purposes
- Attempt to gain unauthorized access to the Service
- Reverse engineer, decompile, or disassemble the Service
- Use automated tools to scrape or extract data at scale
- Resell or redistribute the Service without authorization
3 User Accounts
To use certain features of the Service, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
3.1 Account Responsibility
- You must provide accurate, complete, and current information
- You are responsible for all activity on your account
- You must immediately notify us of unauthorized access
- You must maintain secure passwords and not share login credentials
3.2 Account Suspension
We reserve the right to suspend or terminate your account if we reasonably believe you are violating these Terms or engaging in fraudulent or illegal activity.
4 User Content
"User Content" includes any content you upload, input, or submit to the Service, including keywords, business information, writing instructions, and CMS credentials.
4.1 Your Rights
- You retain all ownership rights to your User Content
- You are responsible for the legality and accuracy of your User Content
- You grant us the right to use your content solely to provide the Service
- You may delete your User Content at any time
4.2 Generated Content
Content generated by our AI tools is created based on your inputs. You own the generated articles and may use them for any lawful purpose, including commercial publication. You represent that you have the right to publish such content and that it does not infringe on third-party rights.
5 Acceptable Use
You agree to use the Service only for lawful purposes and in a way that does not infringe upon the rights of others or restrict their use and enjoyment of the Service.
5.1 Prohibited Conduct
You must not:
- Use the Service to generate spam, malware, or malicious content
- Create content that infringes on copyrights, trademarks, or trade secrets
- Generate false, defamatory, or misleading content
- Use the Service for phishing, fraud, or deception
- Harass, abuse, or threaten other users or employees
- Generate content that violates local, state, national, or international law
- Use the Service in any way that could damage or overload our systems
6 Intellectual Property
6.1 Our IP
The Service, including all text, graphics, logos, images, and software, is the property of Infin8Content or our licensors and is protected by copyright, trademark, and other intellectual property laws.
6.2 Your IP
You retain ownership of your User Content. However, you grant us a worldwide, perpetual license to use your content to provide and improve the Service (excluding any personal or confidential information).
6.3 Feedback
Any feedback, suggestions, or ideas you provide about the Service may be used by us without compensation or acknowledgment.
7 Service Limitations
7.1 Service Availability
- Service is provided on an "as is" basis without guarantees of uptime
- We may temporarily suspend service for maintenance or updates
- Some features may be subject to rate limits or usage caps
- Free trial features may be discontinued at any time
7.2 Subscription Terms
- Subscriptions are billed according to your chosen plan
- Cancellations take effect at the end of the current billing period
- Unused credits or features do not carry over to the next period
- Refunds are not provided for partial months
8 Third-Party Services
The Service integrates with third-party services including Stripe (payments), Supabase (hosting), OpenRouter (AI), and others. Your use of these services is governed by their respective terms and privacy policies.
We are not responsible for the availability, accuracy, or conduct of third-party services. Any issues with third-party integrations should be reported to their respective support teams.
9 Disclaimer
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.
Infin8Content disclaims all warranties including:
- Merchantability or fitness for a particular purpose
- Non-infringement of third-party rights
- Accuracy, completeness, or reliability of content
- Uninterrupted or error-free operation
AI-generated content may contain errors, inaccuracies, or biases. You are responsible for reviewing all generated content before publishing.
10 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, INFIN8CONTENT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
This limitation applies even if Infin8Content has been advised of the possibility of such damages.
Your total liability against Infin8Content for any claims arising from these Terms shall not exceed the amount you paid in the 12 months preceding the claim.
11 Indemnification
You agree to indemnify and hold harmless Infin8Content, its officers, directors, and employees from any claims, damages, or expenses arising from:
- Your violation of these Terms
- Your User Content or generated content
- Your use of the Service
- Your infringement of third-party rights
12 Termination
We may terminate or suspend your account immediately without notice if we reasonably believe you are:
- Violating these Terms
- Engaging in illegal activity
- Harassing other users
- Damaging the Service or other users
Upon termination, your right to use the Service ends immediately. We will retain your data per our Privacy Policy.
13 Modifications to Terms
We may modify these Terms at any time. Significant changes will be communicated via email or in-app notification. Your continued use of the Service after changes indicates acceptance of the new Terms.
14 Governing Law
These Terms are governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. You agree to submit to the exclusive jurisdiction of courts located in the United States.
